TALLAHASSEE —The NCAA infractions committee intends to uphold sanctions against Florida State that would take away wins in 10 sports, including as many as 14 by football coach Bobby Bowden.
After a public records lawsuit and intervention by Florida’s attorney general, the NCAA allowed Florida State to release the committee’s June 2 response to FSU’s appeal of the NCAA punishment that would strip the school of the victories.
Tallahassee attorney Bill Williams, who is handling the case for Florida State, said the university will continue to fight to keep the victories. University officials said they won’t comment until all appeals have been exhausted.
The NCAA said 61 Seminole athletes cheated on an online test in a music history course from the fall of 2006 through summer 2007 or received improper help from staffers who provided them with answers to the exam and typed papers for them.
“The most severe penalties are appropriate when the academic mission of the university has been compromised,” the June 2 infractions committee response said, citing the academic misconduct at the University of Minnesota that led to basketball coach Clem Haskins’ firing.
A former academic counselor at Minnesota admitted to having written more than 400 papers and take-home tests for Gophers basketball players between 1993 and 1998 and said Haskins was aware of the cheating.
The committee’s letter to Florida State said it did not consider taking away wins and a 2007 national championship in track and field as a severe penalty, considering what it called egregious circumstances.
The committee said the conduct of Florida State staff members involved in the cheating scandal was reprehensible.
“This is the response from the committee on infractions which entered the finding that we are appealing so you wouldn’t expect them to change their mind,” said Williams, the attorney handling the case for Florida State. “We will respond to this and then we ultimately have an oral argument before the infractions appeal committee in Indianapolis (Ind.) and then they will make a final decision.”
Williams said he expected the hearing would be scheduled in late summer or early fall, but admitted that was a guess.
“Heck, it could be anytime,” he said.
Bowden, who is preparing for his 34th season at Florida State, would have little chance to stay abreast of Penn State’s Joe Paterno in their competition to finish as major college football’s winningest coach if the penalty sticks. Paterno begins the 2009 season with 383, one more than Bowden.
Florida State did not challenge the loss of scholarship reductions that included two in football this year and another next year.
Florida State played in the 2007 Music City Bowl without two dozen players, including several starters. The Seminoles were defeated by Kentucky. Many of the same athletes were held out of the first three games on the 2008 season as part of their punishment.
Still a very impressive record, and no one enjoyed more success than the FSU’ers for a period of 12 years, but the ride has ended,…..sadly for some, not sadly for others…

Thankfully in this case, the company won,…well, there’s an appeal of course, but they won in round 40,..or 50….Unfortunately, due to the claim, The BWC raised dude’s rates over 100%, and his out-of-pocket expenses to his own grease-ball attorney (who probably split fees with the other lawyer, as that goes on a fair bit too) was $130,000….$130,000 in leagal fees to fight a case that should have NEVER gone past a Judge saying, “NO”! $130,000 that’s taken out of a business, that doesn’t go to HELP anyone!…Its just lawyer fees, so two DICKheads can argue about a slam-dunk case!

TV-Land pulled off the TV equivilent to the Noble prize this weekend, securing 94% of the male population who watched TV at all, by going above and beyond sensible programming, to offer a FULL WEEKEND of “Married w/Children”!…..PURE GENIUS!
Imagine my joy, when at 8am on a Saturday, my daughter runs screaching into my sleep time, to tell me about this great TV phoenix!……The Bundy’s looped for 48 hours+!…..AMAZING! ….fortunatley, I got to see the Bobbi Brown (Miss Cherry Pie girl) episode twice!…TV-Land, you’re now in my Fav 5!

MEMPHIS, Tenn.(AP) Brian Gay thought so little of his chance to play his way into the U.S. Open in his last possible chance that he had plans for a week off. Not even a tentative plan sketched out just in case.
Well, he better figure something out pretty quick. His wire-to-wire victory Sunday in the St. Jude Classic punched his ticket to Bethpage Black.
“Right now I don’t know if we’re going home first or what we’re going to do, whether we spend tomorrow traveling, going home and repacking,” Gay said. “Get to work on Tuesday I guess.”
Gay came to Memphis as one of seven players with a chance to grab the Open exemption as a multiple winner in the last calendar year. He responded with his second win in his last five events and the third victory of his career, beating David Toms and Bryce Molder by five strokes.
“I felt I had to go out and play golf. If I won, I’d get the chance to play,” Gay said.
He grabbed the $1,008,000 winner’s check at TPC Southwind in runaway style, too.
Gay led by only a stroke after each of the first three rounds, then shot his third straight 4-under 66 to pull away. He birdied three of the first six holes to take all the suspense out of the final round, and birdied the 18th to finish at 18-under 262.
Toms finished with a 65, and Molder had a 70. John Senden (64), Paul Goydos (68) and Robert Allenby (69) tied for fourth at 12 under.
“It was a pretty good golf tournament except for one guy stealing the show,” said Toms, the tournament winner in 2003 and 2004.
Phil Mickelson, in his first event since announcing wife Amy has breast cancer, and John Daly, returning from a six-month PGA Tour suspension, tied for 59th at 1 over. Mickelson closed with a 75, and Daly shot a 70.
It wasn’t as large a victory as in April when Gay won by 10 at Hilton Head. It just felt like that on a day where no one could get close enough on wet fairways that stopped balls with almost no roll. Officials had moved up the start by four hours hoping to beat incoming storms that popped up in the morning to delay the start of the final round – by four hours. It didn’t rain again.
Gay needed only 100 putts to become the fourth wire-to-wire winner in the tournament’s 52-year history and first since Justin Leonard in 2005.
Gay started pulling away on the par-3 fourth. After his tee shot landed near the pin and rolled 20 feet past, he rolled in the birdie putt to reach 16 under. Molder hit into a bunker and bogeyed – a swing that gave Gay a four-stroke lead. Gay rolled in a 30-footer on No. 6 and a 17-footer on No. 9 for birdies.
The club let him down on his two bogeys.
He found a greenside bunker pin-high on No. 7 and blasted out to 15 feet, but two-putted. He missed a 9-footer for par on No. 10.
But Gay made up for that by sticking an iron a foot away for birdie on the par-3 11th – the island green – for birdie to go back to 17. That’s when Molder was convinced this was Gay’s tournament.
“I didn’t even get close to catching him,” said Molder, who had his best finish on tour.
From there on, Gay parred six straight holes before finishing in style. He stuck an iron 163 yards to 5 feet of the pin on No. 18, then stroked in his 27th putt of the round for birdie. He celebrated with a fist pump, a high five with his caddie and hugs and kisses from his young daughters.
Mickelson spent the week trying to figure out how to play golf and deal with all the emotions resulting from his wife’s illness. He accomplished that even if the results on course didn’t. He started the final round 10 strokes behind Gay and shot the 75 that featured a triple bogey, three bogeys and three birdies.
“I needed to get a little bit of play in, see where my game was at and get back on the golf course in a competitive frame of mind if I was going to have a chance next week,” Mickelson said. “I’m looking forward to next week’s U.S. Open.
Now he wants to focus on his putting after needing 120 putt this week.
Six children treated at St. Jude Children’s Research Hospital met him coming off the 18th green wearing shirts and a banner that read “Thinking of Amy.” The hospital is this event’s lone charity.
Mickelson talked with the children and signed their shirts.
“These are some pretty cool kids going through something we’re going to go through ourselves here in a few weeks,” he said.

On May 31st, The now imfamous flight 447 from Rio to Paris went down in the Atlantic, killing 228 people. A tragedy of grand proportions,….but, was there more?…..Sure, says the Conspiracy theorists:
The puzzling crash of Air France’s Flight 447 killed two of the world’s “most prominent” illegal arms trade and international drug trafficking foes, according to a little-noticed report.
In a revelation sure to fuel conspiracy theories over the plane’s demise, the report reveals that two key figures in the never ending internecine battle against global arms and drug trafficking perished when the plane abruptly fell out of the sky. Both were particularly active in efforts to stem illegal arms trading in Latin America.
A 39-year Argentinian man, Pablo Dreyfus, was said to be a major player in an effort by Brazilian authorities to stop flow of arms to drug gangs in Rio. He was a consultant for Small Arms Survey, a Geneva-based thinktank.
Another consultant for Small Arms Survey also died in the crash, “Ronald Dreyer, a Swiss diplomat and co-ordinator of the Geneva Declaration on Armed Violence who had worked with UN missions in El Salvador, Mozambique, Azerbaijan, Kosovo and Angola,” according to Scotland’s Sunday Herald.
“Both men were consultants at the Small Arms Survey, an independent think tank based at Geneva’s Graduate Institute of International Studies,” the Herald reported. “The Survey said on its website that Dryer had helped mobilise the support of more than 100 countries to the cause of disarmament and development.”
Dreyfus and Dreyer were reportedly traveling to Switzerland to “present the latest edition of the Small Arms Survey handbook, of which Dreyfus was a joint editor.”
Dreyfus advocated for “stringent labeling” of ammunition produced by weapons companies, the paper said. He averred that such labeling would greatly aid the tracking of arms acquired by criminals.
Dreyfus focused in particular on Brazilian arms firm Companhia Brasileira de Cartuchos which bought Germany’s Metallwerk Elisenhutte Nassau in 2007 and another company in the Czech Republic. He said CBC should “consider the risk that some of these exports end up, via diversions, feeding violence in Brazil.”
“When Rio agents smashed a cell of drug traffickers who had sourced their weapons from the tri-border area, Dreyfus noted its leaders were prominent businessmen living in apartments in the plush Rio suburbs of Ipanema and São Corrado,” the Herald noted.
Though the cause of the crash has not been conclusively determined, most experts have focused on speed sensors that may have affected the plane’s course when it was caught in severe thunderstorms.
“A spokesman for a pilots’ union says all Air France jets taking off now have been equipped with two new-generation speed sensors,” AP reported Tuesday. “The so-called Pitot tubes on the outside of an aircraft are under suspicion in the crash of Air France Flight 447 into the Atlantic Ocean.”
